1. Agreement

By downloading or using Fever & Meds Tracker: FeverKit ("the App"), you agree to these Terms of Service. If you do not agree, do not use the App.

2. Medical Disclaimer

Fever & Meds Tracker: FeverKit is not a medical device and does not provide medical advice.

The App helps parents and guardians log temperature readings, medication doses, and symptoms for reference purposes only. Temperature classifications (such as "elevated" or "fever") are threshold-based labels for organizational purposes and are not diagnoses.

Nothing in the App should be interpreted as a recommendation to take or avoid any action regarding a child's health. Always consult a qualified healthcare professional — your pediatrician or local emergency services — for medical decisions.

If you believe a child is experiencing a medical emergency, call emergency services immediately.

3. Who Can Use the App

The App is intended for use by adults (parents, guardians, and caregivers) on behalf of children in their care. You must be at least 18 years old to use the App and agree to these Terms.

4. Subscription and Payments

Fever & Meds Tracker: FeverKit offers a free tier and an optional Pro subscription ("FeverKit Pro").

• Subscriptions are billed through your Apple ID account via the App Store
• Payment is charged at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• You can manage and cancel your subscription at any time in your Apple ID account settings
• We do not process payments directly and do not have access to your payment information

Refunds are handled by Apple in accordance with their policies.

5. Your Data

All health data you enter in the App (child profiles, temperature readings, medication logs, symptom notes) is stored locally on your device. We do not have access to this data. You are responsible for maintaining your own backups.

6. Acceptable Use

You agree to use the App only for its intended purpose: logging and tracking health information for children in your care. You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or modify the App
• Use the App in any way that could mislead a healthcare professional about a child's medical history

7. Intellectual Property

The App, including its design, code, and content, is owned by Pixelapoteose Lda and protected by copyright and other intellectual property laws. These Terms do not grant you any ownership rights. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be error-free, uninterrupted, or free of bugs. We do not warrant the accuracy of any threshold-based classifications displayed in the App.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Pixelapoteose Lda shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to any reliance on information displayed by the App for medical decisions.

Our total liability to you for any claims arising from these Terms or the App shall not exceed the amount you paid for the App in the twelve months preceding the claim.

10. Changes to These Terms

We may update these Terms from time to time. We will update the "Last updated" date above and, for material changes, notify you within the App. Continued use of the App after changes constitutes your acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of Portugal, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Portugal, unless applicable consumer protection law in your jurisdiction provides otherwise.
